By accessing the Language Magnet Ltd website, you are agreeing to be bound by these website Terms and Conditions, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trade mark law.

Terms

By subscribing to the Language Magnet Ltd subscription service you declare that you are not a private tutor or provide tutoring services, you are not subcribing on behalf of a home education company and you do not intend to use the Language Magnet MFL Platform to teach anyone outside of your immediate household.

The Language Magnet Primary MFL Platform is not a child tutoring service and does not provide language tutors. By subscribing to Language Magnet Ltd, you confirm that you are over 18 years of age and that you will be responsible for tutoring your own child or children with French or Spanish using the Language Magnet resources. You agree to support your child or children's learning at all times when using the Language Magnet MFL Platform and that your child or children will not access the Language Magnet MFL Platform material without your supervision.

By subscribing to the Language Magnet Ltd subscription service, you agree that you are responsible for keeping your account log-in details private and will not share them with any third party, including your child or children.

By signing up for any Language Magnet live session features, you understand that you are the attendee and not your child.

By subscribing to the Language Magnet Ltd subscription service, you and anyone in your household agree to abide by the following terms of use and copyright permission rules pertaining to Language Magnet Ltd.

1) All Language Magnet Ltd downloaded resources and materials are for personal household use only.

2) All Language Magnet Ltd downloadable resources can be printed out and photocopied for your home use only, as many times as is required to deliver the course content for your household during the subscription period.

Permission is granted to use the materials on Language Magnet Ltd's website for personal use only, and for non-commercial transitory viewing and downloading of resources, where permissible, only. This is the grant of a license, not a transfer of title, and under this license you may not:

a) modify or copy the materials.
b) use the materials for any commercial purpose, or for any public display (commercial or non-commercial).
c) attempt to decompile or reverse engineer any software contained on Language Magnet Ltd's website.
d) remove any copyright or other proprietary notations from Language Magnet Ltd materials.
e) transfer the materials to another person or 'mirror' the materials on any other server.

3) No resources on the Language Magnet Primary MFL Platform are to be copied or downloaded onto any electronic transfer device for commercial use or for an external third party.

4) The Language Magnet Primary French Course or Primary Spanish Course downloadable resources may not be redistributed or resold commercially, either in part or in whole, to a third party.

5) The downloadable lesson resource material from the Language Magnet Primary French Course or Primary Spanish Course may not be uploaded onto a personal website or a company website or any social media platform for any reason, including for the purposes of teaching or displaying content.

6) The assessment criteria and student monitoring materials from the Language Magnet Primary French Course or Primary Spanish Course may not be copied using any reproduction device or displayed on a personal website or a company website or any social media platform for any reason, including for the purposes of teaching or displaying content.

7) The downloadable written activity sheets from the Language Magnet Primary French Course or Primary Spanish Course may not be uploaded onto a personal website or a company website for any reason. A photograph of any of the downloadable written activity sheets may only be shared onto a social media platform by the person who has paid for a subscription and only if the activity sheet demonstrates their primary aged child's ability to write in the language being taught and has the child’s written content on the activity sheet itself. No Language Magnet activity sheet can be shared on social media if there is no child's writing on the activity sheet in the foreign language being taught.

8) If you cancel or pause your subscription to the Language Magnet MFL Platform, then all Language Magnet Ltd resources that have been downloaded are to remain with the household for which the subscription was purchased. As an ex-subscriber, you may no longer continue to access the Language Magnet MFL Platform unless you reactivate your subscription.

9) The copyright in course materials produced by Language Magnet Ltd for the purposes of the curriculum of the Primary French Course and of the Primary Spanish Course produced and all extra-curricular resources, downloaded or used by the subscriber, shall belong to Language Magnet Limited.

10) Attention is drawn to the provision of the Copyright Designs and Patents Act 1988 which provides that copies of any copyright material (including printed matter, computer programmes, sound or film recording and broadcast material) are only made with the permission/licence of the copyright owner and therefore in the event of doubt, advice should be sought from Language Magnet Ltd before any copies of materials are made where the conditions are not set out in the Terms of Use.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Language Magnet Ltd at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any copied/downloaded materials in your possession whether in electronic or printed format.

By subscribing to the Language Magnet Ltd subscription service, you agree to make all your household members who use the Language Magnet MFL Platform aware of their personal obligations under this agreement.

By subscribing to the Language Magnet Ltd subscription service, you agree to make known to Language Magnet Ltd any unauthorised use of your login details for the Language Magnet MFL Platform subscription service and portal.

You agree for your subscription payments to be set to auto-renew at the end of the subscription period, which can be set to monthly, quarterly or yearly when purchasing a subscription. If you do not wish to renew your subscription you have the right to cancel the auto renewal by emailing diana@languagemagnet.com

A 7 day Free Trial is provided when you first sign up for a subscription package. Payment will automatically be made to Language Magnet Ltd after the 7 day Free Trial, unless you cancel your subscription within the trial period.

The amount of content from the Language Magnet French or Spanish Courses available on the 7 day Free Trial is limited to Modules 1 to 3, enabling sufficient course content to be viewed to help inform your decision as to whether you want to continue with a paid subscription or not.

With a monthly or quarterly subscription, Modules 4 to 12 of the Language Magnet French or Spanish Courses will be released to subscribers every 3 weeks, after the first full paid subscription month, to provide a learning experience that is suitable for a progressive course.

With a yearly subscription, all 12 modules of the Language Magnet French or Spanish Course will be released to subscribers, after the 7 day free trial period, to provide a learning experience that is suitable for fast track learning.

Right To Cancel

If for any reason you are not satisfied with the Language Magnet subscription service, you have the right to cancel your subscription within 14 days of your purchase and you will be eligible for a full refund.

Disclaimer

The materials on the Language Magnet Ltd website are provided 'as is'. Language Magnet Ltd makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Language Magnet Ltd does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet website or otherwise relating to such materials or on any sites linked to this site.

Limitations

In no event shall Language Magnet Ltd or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on the Language Magnet Ltd Internet site, even if Language Magnet Ltd or a Language Magnet Ltd authorized representative has been notified orally or in writing of the possibility of such damage. Language Magnet Ltd takes no responsibility for the reliability or consistency for your personal Internet connection.

Revisions and Errata

The materials appearing on the Language Magnet Ltd website could include technical, linguistic, typographical, or photographic errors. Language Magnet Ltd does not warrant that any of the materials on its website are accurate, complete, or current. Language Magnet Ltd may make changes to the materials contained on its website at any time without notice. Language Magnet Ltd does not, however, make any commitment to update these materials on a daily basis.

Governing Law

Any claim relating to Language Magnet Ltd's website shall be governed by the laws of the United Kingdom without regard to its conflict of law provisions.

As an Instructor, You represent, warrant, and covenant that: No Submitted Content shall infringe or misappropriate any intellectual property right of a third party. But, if instructor use HEVC compression, it's the instructor's responsibility to pay the royalties to the MPEG-LA, the owner of HEVC patents as appropriate.
